ASIC now accepts electronic signatures on Form 362

So, we are pleased to share a meaningful update that streamlines one of the more common steps in corporate compliance. ASIC has officially updated its Electronic Lodgement Protocol (ELP) to allow electronic signatures on Form 362 — the form used to nominate or cease a registered agent or contact address.

This may seem like a small procedural change, but for fast-moving businesses, it marks a significant step towards more efficient onboarding and compliance processes.

What has changed?
Previously, lodging a Form 362 involved signing a hard copy and physically mailing it. It was hardly ideal for international businesses trying to establish or manage operations remotely.

Now, ASIC Registered Agents like us at ABN Australia can collect and store Form 362 electronically, using any of the following signing methods:

  • A physical signature on a printed version of the form
  • A signature written on a touchscreen (e.g., stylus or finger on a tablet)
  • A digital image of the signatory’s usual signature

Importantly, the form must still be signed by a current company officeholder, but now that can happen much faster and in a more seamless way, no matter where the signatory is located in the world.
